Ms. Gianola's practice encompasses all facets of civil litigation from inception to negotiated resolution to trial with an emphasis on the areas of real estate litigation, business litigation, and intellectual property litigation. She represents clients before both federal and state courts and before administrative tribunals. She has also authored appellate briefs and argued before both federal and state appellate courts.

Representative Experience:

  • Representation of developers, builders, commercial and residential landlords and tenants, and corporations in disputes involving commercial and residential leases, land development, and construction contracts.
  • Representation of general contractors and subcontractors in litigating and arbitrating construction disputes.
  • Representation of business owners in trademark infringement matters.
  • Representation of landowners in easement disputes.
  • Representation of a governmental agency in a $40 million development project.
  • Defense of a non-profit school in a lawsuit to adjudicate rights to groundwater in a California coastal basin.
  • Defense of an aircraft manufacturer in a lawsuit to determine ownership of an aircraft type design.
  • Representation of an agricultural producer and distributor in a lawsuit for breach of a sales contract for a patent.

In addition to her practice, Ms. Gianola has published and lectured on international comparative land use issues and is a visiting scholar of the University of California, Berkeley. She served as Vice Chair of the Executive Committee, Real Property Law Section, of the California Bar and legal counsel and Member of the Board of Trustees for the World Affairs Council of the Monterey Bay area. She has provided pro bono legal services for the Lawyers' Committee for the Civil Rights of the San Francisco Bay Area.
